This was an action brought by the Pleasant. Hill Cemetery association against C. M. Hunt, for the recovery of $18. The defense of the defendant was, that he was the treasurer of the cemetery association, and entitled to the custody of its funds; and the only substantial question involved in the case or litigated in the court below is, and was, whether he was in fact such treasurer.
