Affirming.

Iu August, 1935, the city of Covington, suing for itself and on behalf of all resident gas consumers of the city, brought its action in the Kenton circuit court against the Union Light, Heat and Power Company seeking to recover of the company a refund on rates paid for gas under the provisions of certain interrelated gas franchises, ordinances, etc., granted and enacted by the cities of Covington, Kentucky, and Cincinnati, Ohio.
