Crim Uhls, administrator of the estate of Maynard Uhls, deceased, herein referred to as the plaintiff, instituted suit in the circuit court of Franklin county against the Old Ben Coal Corporation and Central Illinois Public Service Company to recover damages arising by reason of the alleged wrongful death of his intestate son, 12 years of age. At the conclusion of plaintiff’s evidence, the court directed a verdict for the Public Service Company and the court’s ruling on that motion is not now before the court.
