Defendant is charged under docket No. CR17463B/94 with a violation of section 265.01 (2) of the Penal Law, possession of a weapon in the fourth degree. The defendant moves this court to preclude the People from introducing at trial any statements allegedly made by the defendant to the police based upon the People’s failure to comply with the 15-day period proscribed by CPL 710.30.
