On August 20,1924, the Hamilton-Brown Shoe Company, a foreign corporation, filed this suit against the appellants, Julius Berwald, Ben L. Berwald, and Max Hermer, upon an open account for the sum of $1,494.81 for merchandise sold to them dur ing the years 1923 and 1924. It was alleged that the defendants, at the time the goods were sold, were partners' doing business under the name of the Ben L.
