In an action, inter alia, to recover damages for breach of a construction contract, defendant appeals from (1) an order of the Supreme Court, Richmond County (Rubin, J.), dated October 13, 1983, which granted plaintiff’s motion for leave to serve a second amended verified complaint and (2) an order of the same court, dated October 14, 1983, which denied defendant’s cross motion for partial summary judgment dismissing plaintiff’s fifth and sixth causes of action.

Orders affirmed, with one bill of costs.
