October 9, 1933, in a suit to recover alleged commissions for the sale of certain proper Ly, brought by relator and another, against W. H. Stark, Miriam M. Stark, wife of W. -H. *866Stark, and H. J. Butcher Stark, in the district court of Orange county, a judgment was rendered in favor of tke defendants.
