OPINION OF THE COURT

FLETCHER, Chief Judge:

Petitioner appears before us in a petition for extraordinary relief1 challenging the legality of his pretrial confinement.2 *269He asks that we order his immediate release from confinement and the dismissal of all charges against him. He also alleges that the trial judge’s refusal to grant him a hearing to determine the legality of his pretrial confinement constituted a denial of due process of law under the Fifth Amendment to our Constitution.
