On further appellate review (G. L. c. 211A, § 11), we state our reasons for agreeing with the ruling of the Appeals Court on a question of former adjudication. Rudow v. Fogel, 6 Mass. App. Ct. 822 (1978).

William Rudow, a minor, by his father Marvin, in 1973 commenced the present action in the Superior Court, Essex County, against his uncle Albert Fogel to obtain a judgment that Fogel holds certain real property in Rock-port on a trust for him, William.
