Appellee, J. D. Wyrick, as plaintiff, filed this suit in the district court of Angelina county against appellant, J. D. Miller, as defendant, to recover damages for personal injuries sustained by him when his automobile truck collided with a truck owned and being operated at the time by the defendant. The collision occurred on a paved highway about two miles south of Lufkin, in Angelina county, on March 29, 1935.
