I concur in affirmance of the district court’s judgment reinstating the plaintiff and awarding him back pay and fringe benefits lost. I also concur in reversal of the district court’s finding of liability and judgment against the board of trustees, awarding damages of $5,000.00 for a claimed tort along with attorney fees of $2,172.55, as punitive damages. In the reversal aspect, I concur for different reasons than those set out in the major opinion, with which I disagree.
