OPINION and JUDGMENT

DALTON, Chief Judge.

This proceeding comes before the court on a petition for a writ of habeas corpus filed in forma pauperis by Jesse Ben Haley, Jr., a prisoner of the State of Virginia, pursuant to the provisions of 28 U.S.C.A. § 2241.

Petitioner is currently serving a sentence of ten years in the Virginia State Penitentiary pursuant to a judgment of the Corporation Court of the City of Martinsville, February 17, 1966, wherein he was convicted of the crime of grand larceny. Petitioner, at the original proceeding, February 17,1966, was banished from the State of Virginia.…
