MEMORANDUM OPINION AND ORDER

ASPEN, District Judge.

The twenty-eight count indictment in this case names eleven defendants; although only eight defendants are to be tried in this Court. 1 Count 1 charges that four defendants, along with unindicted co-conspirators, conspired to participate in the affairs of a racketeering enterprise. 18 U.S.C. § 1962(d) (1982) (“RICO”). Counts 2-5 charge each RICO co-conspirator with substantive RICO violations.
