1. Appeal: costs to transcripts. — I. October 15, 1889, plaintiff filed a denial of the correctness of defendant’s abstract with amended abstract. On the same day, defendant filed a motion to tax the costs of the transcript and amended abstract to the plaintiff, on the grounds that the abstract was full and true. The case was submitted October 18, under an agreement in open court that it should be considered upon the abstract and the amended abstract, and examination of the transcript waived.
