This action was brought against the defendant, now deceased, to recover damages alleged to have been done to the real estate of the plaintiff by means of certain nuisances, kept up and maintained by the defendant, upon his premises adjoining. In one count of the declaration (it is not necessary to cite other similar counts) the plaintiff alleges, that he was the owner and proprietor of a hotel, called the “ Aldrich House,” of great value for sale or for lease, and paying a large annual rent.
