Appeal from a judgment of the Supreme Court (Feldstein, J.), entered June 2, 2016 in Franklin County, which dismissed petitioner’s application, in a proceeding pursuant to OPTJ?. article 78, to review a determination of respondent Erie County Sheriff calculating petitioner’s jail time credit.
In 2003, petitioner was sentenced to an aggregate prison term of 5 to 15 years. He was paroled in May 2009, but twice violated parole and was returned to custody, the second time in April 2010.
