Statement of the Case.
NICHOLLS, J.
J. H. Curlee and C. A. Dutherage carried on business together as a commercial partnership in the city of Shreveport, under the name of J. H. Curlee & Co. Curlee died in September, 1905. The business of the partnership was the conducting of a liquor saloon in a rented building. In one of the rooms gambling was carried on. The gambling feature was discontinued during the liquidation. The record does not disclose what the terms of the partnership *565were: but, as the house was rented for the year 1905, and the partnership had obtained a license for keeping a saloon…
