The defendant was charged with one count of criminal possession of a controlled substance in the fifth degree (Penal Law § 220.06 [5]), for possessing more than 500 milligrams of cocaine on June 5, 2000. On August 17, 2000, the People moved to reduce the charge to criminal possession of a controlled substance in the seventh degree (Penal Law § 220.03), because the New York City Police Department (NYPD) laboratory report showed that the cocaine seized from the defendant weighed only 1.2 grains (approximately 77.8 milligrams) of cocaine.
