Plaintiff Kim Thomas brings this action on behalf of her daughter, N.T., to challenge a decision of the Commissioner of Social Security denying N.T.’s application for surviving child insurance benefits under the Social Security Act (the “Act”). The case turns on whether N.T. is the child of deceased wage earner Ronald Van Thomas (“Thomas”), a question that an administrative law judge (“ALJ”) answered in the negative in a decision that later became the final decision of the Commissioner.
