This was an action on the case, brought by Jeremiah Carroll against the Chicago and northwestern Bail-way Company, to recover damages for a personal injury received by the plaintiff, as he claims, by means of the negligence of the servants and employes of the-defendant. The injury was received on the 30th of May, 1877, while the plaintiff was being carried on one of the defendant’s passenger trains from Chicago to Calvary, a station situated about ten miles north of the defendant’s depot at Chicago.
