Defendant appeals by right from his jury trial conviction for second-degree murder, MCL 750.317; MSA 28.549, and assault with intent to commit murder, MCL 750.83; MSA 28.278. Defendant claims that he could not properly be charged with the assault count and that he was deprived of a fair trial by the failure of the prosecutor or the court to inform the jury that one of the prosecutor’s witnesses had been granted immunity during trial. We vacate the conviction and *428sentence for assault with intent to commit murder and affirm the murder conviction.
