Plaintiffs, Joseph M. Hanchey and G.C. Bailey, entered into a written contract with the defendants, Victor J. Kildair and Joe Harper, a partnership, whereby the plaintiffs agreed to furnish all labor and material and construct for the defendants a store building for the sum of $3,068, to be paid on the completion and acceptance of the building.
