LIVELY, Circuit Judge.

The question in this case is whether the surviving or resultant corporation in a statutory merger acquires patent license rights of the constituent corporations. The plaintiff, PPG Industries, Inc. (PPG), appeals from a judgment of the district court dismissing its patent infringement action on the ground that the defendant, Guardian Industries, Corp. (Guardian), as licensee of the patents in suit, was not an infringer.
