This action is brought by the plaintiff against the defendant to recover the sum of $285 paid by the plaintiff to the defendant on account of a conditional sale of pool tables, and which pool tables were subsequently retaken by the defendant. The case was tried before the court without a jury. The pool tables and appurtenances were sold by the defendant to the plaintiff under a conditional bill of sale, the title not to vest in the vendee until the tables had been paid for.
