Catherine C. Padgett (hereinafter plaintiff) brought this action against Emory University; P. N. Symbas, M. D.; William R. Higgs, M. D.; and Fulton-DeKalb Hospital Authority (hereinafter defendants) seeking damages for medical malpractice arising out of a surgical procedure performed upon her at Grady Memorial Hospital on December 18, 1975. This action was originally brought in DeKalb County on February 16, 1979. The DeKalb County suit was voluntarily dismissed without prejudice, and suit was filed within six months in Fulton County.
