The jury having awarded a verdict in favor of the defendant, a motion was then made by the plaintiff to set aside the verdict and for a new trial on the grotmd that the verdict so rendered. by the jury was contrary to law and contrary to the evidence. The action was brought to recover damages for injuries inflicted upon the plaintiff’s property by the defendant while engaged in blasting rock upon premises in the rear of plaintiff’s premises.
