Union Carbide & Carbon Corporation, hereinafter referred to as plaintiff, instituted this action of trespass on the case in the Circuit Court of Jackson County against Linville, a resident of Lincoln County, West Virginia, and Miller and Lovejoy, residents of Cleveland, Ohio, to recover damages incurred by reason of a collision of two motor vehicles in Jackson County.
