Plaintiff, as the administrator of the estate of Domenico Cis, brought separate actions to determine ownership of two bank deposits, one in the Crocker First National Bank, and the other in the Bank of America. Cross-complaints were filed by two minor nephews of the deceased through their father as guardian ad litem, each nephew claiming title to one of the deposits. The two cases were consolidated and tried upon an agreed statement of facts.
