The complaint is on a check executed and delivered in the State of Florida. The defense is that the consideration for the check was a loss suffered in a game of cards commonly known as poker. The parties to the suit are residents of this State, and indulged in this game of poker during a winter vacation at a Florida resort. A contract based upon a game of poker for money, in this State, is made void by the statute law.
