KRUEGER, Judge.

The appellant was tried and convicted of the offense of theft of property over the value of $50, and *387his punishment assessed at confinement in the State penitentiary for a term of two years.

The record in this case discloses that a few days prior to the 12th day of January, A. D. 1933, the appellant, his brother, and Ross Davis were seen in a truck near Voss and Valera on their way to Corpus Christi.
