BLAIR, Justice.

This appeal involves the question of the sufficiency of a tender of the amount due on the note in suit to bar recovery of the 10% attorney’s fees stipulated and the court costs.

The note, dated January 27, 1942, for $1,500 was executed by Marvin C. Patterson, Alva Patterson, and W. W. Scott, payable to Mutual Deposit & Loan Company, in monthly installments of $18. The payee was a.building and loan association, and the note was given for stock in the association, and was also secured by a deed of trust lien on certain real estate.
