Action to recover for services alleged to have been performed for defendant. A verdict was directed for defendant on the trial in the court below, and plaintiff appeals from an order denying a new trial.

The facts are as follows: Defendant is a corporation organized and created under the laws of this state for the purpose of doing a general storage and commission business at Duluth. Plaintiff *439was a stockholder in the corporation, and was duly elected its treasurer in January, 1898.
