Appeal from a decision of the Workers’ Compensation Board, filed October 6, 2008, which, among other things, ruled that claimant’s application for workers’ compensation benefits was time-barred by Workers’ Compensation Law § 28.
On September 11, 2001 and the days that followed, claimant — a civil employee of the New York City Fire Department — was charged with cleaning and repairing fire trucks that had responded to the scene of the terrorist attacks that had occurred at the World Trade Center.
