Plaintiff sues defendant for damages for the death of her husband. Defendant filed an answer denying liability and categorically answered each paragraph in the petition and pleaded contributory negligence and incorporated in the answer an exception of no cause of action.

On the day the case was set for trial on the merits, counsel for the defendant objected to any evidence being offered by the plaintiff on the ground that the petition did not set forth a cause of action.
