— Plaintiff, Maud Richards, executrix and substituted trustee under the last will and testament of Howard Richards, deceased, filed a complaint in assumpsit against defendant, County of Schuylkill, on March 31,1958. On April 21, 1958, defendant filed preliminary objections to the complaint. The preliminary objections were overruled on July 21, 1958, and defendant was granted 20 days within which to file an answer. On August 7, 1958, defendant filed an answer and plaintiff filed a reply on October 1, 1958. Defendant then moved for judgment on the pleadings on October 17, 1958.
