PERRY, Judge.

Dale Ernest Patterson appeals from his judgment of conviction and sentences for two counts of delivery of a controlled substance. For the reasons set forth below, we affirm.

FACTS AND PROCEDURE

Patterson was charged with two counts of delivery of a controlled substance, I.C. § 37-2732(a), with aggravating factors for each count for delivering within 1000 feet of a school, I.C. § 37-2739B(b)(2), and for having a prior conviction for delivery of a controlled substance, I.C. § 37-2739B(b)(l).
