Johnson, Judge:

This is a protest against the collector’s assessment of duty on battery movements sent abroad for repairs and on other merchandise at 75 cents each under paragraph 367(a) (2) of the Tariff Act of 1930, as modified *211by T.D. 63661. It is claimed that the merchandise is free of duty under paragraph 1616 of said tariff act, as amended, infra.

Counsel have submitted this case on a stipulation reading as follows:
