delivered the opinion of the court.

Plaintiff brought an action against defendant to recover $3,000 claimed to be due her under the terms of a written contract entered into between the parties May 14,1941. There was a trial before the court without a jury, a finding and judgment in plaintiff’s favor for $3,000 and defendant appeals.

The record discloses that the parties were married March 12, 1921, at Chicago, and on May 9, 1941, she filed her complaint for divorce in the Superior court of Cook county, and while the suit was pending, the parties entered into the…
