Affirming.
On February 25th, 1913, the grand jury of Bus-sell county returned an indictment against Arthur Brockman, Lucien Brockman and Silas A. Sullivan charging them with the offense of stealing public records. The indictment alleged a conspiracy between them to steal certain indictments against Arthur Brock-man and charged that, in pursuance of said conspiracy and while the same existed, they did unlawfully, feloniously and fraudulently take, steal and carry away the indictments in question.
