The post-conviction relief (PCR) judge vacated respondent-petitioner Herman Winns’s conviction for murder, after finding that the indictment was defective because it failed to state the time and place of the victim’s death. The PCR judge also ruled that Winns’s claims regarding ineffective assistance of counsel lacked merit. This Court granted the State’s petition for certiorari on the indictment issue and Winns’s petition for certiorari on the ineffective assistance of counsel issues.
