This case is here upon writ of error to the Circuit Court of Broward County.
This suit was brought in the name of W. B. Snyder and E. H. Hart but the trial court sustained a demurred alleging misjoinder of plaintiffs and thereby eliminated W. B. Snyder from the case as plaintiff.
The declaration is in five counts the first of which is based upon an express contract while the remaining four are common counts. After the trial court had sustained a demurrer to the first count "without leave of the plaintiff to amend said first count," the case went to trial on the second count "for money payable…
