Plaintiff LaPratt was convicted on February 9, 1965, in the justice court for the city of Keego Harbor, of assault and battery, a misde*659meanor violation of a city ordinance. He was fined $35 and ordered to pay $15 costs. The defendant herein is the justice of the peace before whom plaintiff was tried.

Plaintiff subsequently furnished his recognizance and filed a complaint for an order of superintending control in the circuit court for the county of Oakland. This complaint alleged, among other things, that the city attorney failed to summon or otherwise have present at plaintiff’s misdemeanor…
