In a neglect proceeding pursuant to section 614 of the Family Court Act, the appeal is from an order of the Family Court, Kings County, dated January 12, 1978, which dismissed the petition. Order reversed, on the law, without costs or disbursements, and proceeding remitted to the Family Court for consideration of the petition on the merits. In 1973 the Family Court placed Mickey B. with the Commissioner of Social Services of the City of New York for a period of 18 months.
