Judgment unanimously affirmed. Memorandum: Sometime after midnight on September 8, 1984, defendant was seen by two witnesses running from the porch of a house located at 3 Maple Street in the Village of Franklinville, New York. Within 10 minutes, that house was in flames and three people were killed in the fire. Defen*959dant was observed at the fire scene by the same two witnesses who had observed him earlier and they reported this fact to a local police officer.
