The plaintiff in error is the owner of certain real estate situated in the city of Gallipolis, Ohio. The defendants in error at the time this action was instituted were, and had been, in possession of said real estate for many years, claiming to hold the same under favor of a certain written lease made in July, 1905, by one John C. Shephard, who was then the owner of the real estate. The written lease was for a term of 25 years, and was neither witnessed nor acknowledged as provided by law.
