Appeal by the People from an order of the Supreme Court, Kangs County (J. Goldberg, J.), dated September 18, 2009, which granted the defendant’s motion pursuant to CPL 440.10 to vacate a judgment of the same court rendered May 30, 2008, convicting the defendant of burglary in the first degree, and imposing sentence.
Ordered that the order is affirmed.
