On the 11th day of July, 1924, in the County Court of Queens county, the defendant was found guilty of receiving stolen property in the first-degree, as a second offense. The Appellate Division reversed the judgment of conviction on the law and ordered a new trial, the facts having been examined and no error found therein. In its memorandum opinion, that court held that it was error for the trial judge to charge the jury that the burglary of the Frank store in Hempstead had been established, and that the jury need not waste any time discussing the question, citing People v.
