SOBELOFF, Circuit Judge:
The question presented by this appeal is one of coverage under an automobile liability insurance policy. Appellee Andrew Byrd Pinkard was driving an automobile owned by Clifton Hanks, who was seated beside him, when the vehicle left the road and struck a telephone pole. Pinkard was injured and Hanks was killed. Hanks’ insurer brought a diversity action in the United States District Court to obtain a declaration that it was not obligated under the automobile liability policy issued to Hanks.
