The plaintiff’s declaration contains three counts, the first and third of which are against the defendants as indorsers, of a promissory note. These, however, are not in controversy; and the only question before the court relates to the second count. In this the plaintiff declares on a promissory note, executed by the defendants, jointly, with Wheeler Grant and Thomas C. Wattles.
