This decision addresses motions made in two separate but related actions.*

The plaintiffs in action No. 1 are nonunion employees of Green Bus Lines, Inc., Triboro Coach Cdrp., Jamaica Buses, Inc., and Command Bus Company, Inc. (the bus companies). They commenced this action against defendants City of New York and the Metropolitan Transportation Authority (the MTA) by the filing of a summons and complaint on June 10, 2004.
